Terms of Service
These Terms of Service ("Terms") govern your use of the ScrollPact mobile application ("App") on iOS. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Description of Service
ScrollPact is a mobile app that helps you:
- Use your device camera with on-device pose detection to count exercises (push-ups, squats, jumping jacks) and track a running timer.
- Earn "unlock minutes" based on completed exercises and store your exercise sessions locally.
- Temporarily unlock selected apps for a limited time based on your selected apps and unlock duration.
- Receive daily reminders via the system notification service.
- Optionally manage a profile name and avatar stored locally.
- Use subscription purchases to remove usage limits and access paid features.
Exercise session processing and storage are performed on your device. We do not operate servers that store or process your exercise session content.
2. Eligibility
You must be at least 13 years of age (or the applicable age of consent in your country) to use the App, or have your parent or guardian's permission. If you are a parent or guardian, you are responsible for the use of the App by minors under your care.
3. Acceptable Use
You agree to use the App only for lawful purposes and in line with these Terms. You must not:
- Use the App to harass, bully, harm, or invade the privacy of others.
- Use the App to capture, store, or share content in a way that violates applicable law or third-party rights.
- Attempt to reverse-engineer, decompile, or extract the App’s source code, except as allowed by applicable law.
- Use automated means (e.g. bots or scripts) to access or use the App in ways we did not intend.
We may suspend or terminate your access to the App if we believe you have violated these Terms or applicable law.
4. No Account or Login
ScrollPact does not require you to create an account or log in for core exercise tracking. Exercise data is stored locally on your device. You are responsible for keeping your device secure and for any use of the App on your device.
5. Subscriptions, Purchases, and Free Trial
The App may display information about subscription plans (e.g. monthly or yearly). Such information is for reference.
Free use (first-time)
For new users, the App allows free use one time for the first successful flow where you complete an exercise to unlock selected apps (i.e., you can start the camera recognition once and then complete that unlock workflow).
After the free use is consumed, continued access to camera recognition (when not otherwise unlocked) may require a subscription.
Paid subscriptions
When in-app purchases are available, additional terms and Apple’s terms will apply. Payment processing is handled by Apple. We do not store your payment details.
You can restore purchases through Apple’s restore flow available in the App.
6. Intellectual Property
ScrollPact, including the App’s name, logo, design, and code, is owned by us or our licensors. You may not copy, modify, or distribute our intellectual property without our prior written consent.
You retain ownership of the data you generate and store on your device; we do not claim ownership of your local content.
7. Disclaimers
- Not medical or professional advice. ScrollPact is an exercise tracking and productivity helper. It is not a substitute for medical, health, or professional fitness advice. Do not rely on the App for diagnosis or treatment. Stop exercising if you experience pain or discomfort and consult a qualified healthcare professional.
- Accuracy is not guaranteed. Pose detection and counting are based on camera input and may be inaccurate depending on lighting, camera angle, or your body position.
- "As is" service. The App is provided "as is" and "as available". We do not guarantee that it will be error-free, secure, or uninterrupted. Use of the App is at your own risk.
8. Limitation of Liability
To the maximum extent permitted by applicable law:
- We and our affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of data, profits, or goodwill) arising from your use or inability to use the App.
- Our total liability for any claims related to the App shall not exceed the amount you paid us for the App in the twelve (12) months before the claim (or, if you paid nothing, zero).
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
9. Indemnification
You agree to indemnify and hold harmless us and our affiliates, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your content, or your violation of these Terms or applicable law.
10. Changes to the App and These Terms
We may update the App or these Terms from time to time. We will indicate the "Last updated" date at the top of these Terms. Continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree, you must stop using the App.
11. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict-of-law rules. Any dispute arising from these Terms or the App shall be resolved in the courts of that jurisdiction, except where prohibited by law.
12. Severability
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
